Emergency Alert Button – Terms and Conditions

By accessing or using the Emergency Alert Button (the “Feature”), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Feature.

1. Purpose

The Feature provides a direct communication channel to an on-call engineer. Activation of the Feature will send a high-priority alert to the engineer’s personal phone, which may produce a loud notification, including during off-duty or sleeping hours. The Feature is intended strictly for critical business emergencies, including but not limited to:

  • Complete system outages or failures;
  • Significant operational disruptions affecting business continuity;
  • Loss of revenue or other business-critical events.

2. Permitted Use

The Feature must be used solely for genuine emergencies. Any use for minor issues, non-critical matters, or frivolous purposes constitutes a violation of these Terms and may result in disciplinary measures, including revocation of access.

3. Access and Revocation

Hartex Software expressly reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Feature at any time. Such actions may occur for any reason, including but not limited to misuse, repeated activation without justification, or violation of these Terms.

4. Responsibility and Acknowledgment

By using the Feature, you acknowledge and agree that you are solely responsible for ensuring its appropriate use. You understand that improper use may disrupt the engineer’s personal time and may result in the loss of access or other consequences.

5. Limitation of Liability

Hartex Software shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Feature, including any losses incurred due to misuse or failure to activate the Feature during an emergency.

6. Amendments

Hartex Software may update these Terms and Conditions at any time. Continued use of the Feature constitutes acceptance of the amended Terms.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Hartex Software is registered, without regard to its conflict of law provisions.
